By accessing the Lumapharm website, logging into the client portal, placing a purchase order, or otherwise engaging with Lumapharm, you confirm that you are an authorized representative of a business entity and that you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use our website, portal, or services.
2. Client Portal Access & Credentials
Access to the Lumapharm client portal ("Portal") is granted exclusively to approved business clients who have made a qualifying purchase. Portal accounts are not self-registered — Lumapharm creates and issues all credentials at its sole discretion.
Your responsibilities as an account holder:
You are responsible for maintaining the strict confidentiality of your login credentials and for restricting access to authorized personnel within your organization only. You may not share credentials with third parties outside your organization, transfer them to another business entity, or use them for any commercial purpose beyond accessing your own account materials. You are responsible for all activity that occurs under your account.
If you suspect unauthorized access to your account, notify Lumapharm immediately at devices@lumapharm.com.
Portal content:
The Portal provides access to marketing materials, device training content, product protocols, and related resources tied to your Lumapharm purchases. All content is made available solely for your internal business use in connection with the products you have purchased from Lumapharm.
Availability:
Lumapharm reserves the right to modify, suspend, or terminate Portal access at any time, including in the event of a breach of these Terms, non-payment, or conduct deemed harmful to Lumapharm's business or reputation. Lumapharm may update or remove Portal content at any time without liability.
3. Sales & Purchase Terms
All purchases are governed by these Terms alongside your purchase order, invoice, and any applicable distributor or sales agreement. In the event of a conflict, the distributor agreement takes precedence, followed by the purchase order, then these Terms.
Ordering:
Purchase orders must be submitted through the authorized Lumapharm sales process. All orders are subject to acceptance by Lumapharm and product availability. Lumapharm reserves the right to refuse or cancel any order at its discretion.
Pricing & payment:
Prices are as quoted by your Lumapharm sales representative and are subject to change prior to order confirmation. Unless otherwise agreed in writing, payment terms are net 30 days from invoice date. Lumapharm reserves the right to charge interest on overdue balances at the maximum rate permitted by applicable law.
Returns & refunds:
All sales are final unless otherwise agreed to in writing by Lumapharm. Defective products will be handled in accordance with the applicable device warranty or return policy communicated at the time of purchase. Lumapharm does not accept returns of opened or used consumable products.
Resale restrictions:
Products purchased from Lumapharm may only be resold in accordance with applicable law and any restrictions communicated at the time of sale. Resale through online marketplaces or to unauthorized parties is strictly prohibited without prior written consent from Lumapharm.
4. Product Use & Liability
Lumapharm devices and professional skincare products are intended solely for use by trained, licensed aestheticians, spa owners, and skincare professionals. By purchasing and using Lumapharm products, you agree to the following:
Training requirement:
You and all staff operating Lumapharm devices must complete all applicable training programs, provided through the client portal or directly by Lumapharm, before performing treatments. Training materials support safe use and do not substitute for any professional licensing or regulatory requirements in your jurisdiction.
Regulatory compliance:
You are solely responsible for ensuring that your use of Lumapharm products complies with all applicable federal, provincial, state, and local laws and professional standards, including those governing the practice of aesthetics, cosmetology, and the marketing of related services.
No medical advice:
Nothing provided by Lumapharm , including training materials, product protocols, or communications from Lumapharm staff, constitutes medical advice. You are solely responsible for assessing client suitability and contraindications prior to any treatment.
Assumption of risk:
You assume full responsibility for any adverse outcomes, client injuries, regulatory violations, or other consequences arising from the use or misuse of Lumapharm products. Lumapharm shall not be liable for failures to follow provided protocols, use outside intended purpose, or non-compliance with applicable law.
Limitation of liability:
To the maximum extent permitted by applicable law, Lumapharm's total liability to you for any claim arising from product use shall not exceed the amount paid by you for the specific product giving rise to the claim in the twelve (12) months preceding the claim.
5. Changes to These Terms
Lumapharm reserves the right to update these Terms at any time. Material changes will be reflected in a revised effective date. Continued use of the Portal or Lumapharm products following any update constitutes acceptance of the revised Terms.
